Welcome to Illuminating Watercolor.
These Terms of Service (“Terms”) constitute an agreement between you and Dylan Scott Pierce Studios (“DSP Studios,” “we,” “us,” or “our”) and govern your access to and use of:

as well as the courses, instructional videos, live classes, workshops, critiques, community features, downloadable resources, reference materials, memberships, subscriptions, and other services made available through Illuminating Watercolor (collectively, the “Services”).
By visiting our websites, creating an account, purchasing a membership, or otherwise using the Services, you agree to these Terms.
If you do not agree to these Terms, please do not use the Services.
1. About Illuminating Watercolor
Illuminating Watercolor is an online watercolor education membership operated by Dylan Scott Pierce Studios.
The Services may include:
on-demand watercolor courses and demonstrations
live class series
live workshops
critiques and question-and-answer sessions
recordings of live instruction
downloadable handouts and guides
reference photographs and educational resources
community features
watercolor exercises and demonstrations
other educational content and membership benefits
Membership features vary depending on the plan selected.
The content, benefits, pricing, and access included with a particular membership plan are those displayed on the applicable membership or checkout page at the time of purchase.
2. Eligibility
You must be legally able to enter into a binding agreement in order to purchase or maintain a membership.
If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
Children under the age of 13 should not create an account or submit personal information without legally required parental or guardian consent.
3. Your Account
Certain portions of Illuminating Watercolor require a member account.
You agree to provide accurate and current information and to maintain the confidentiality of your username, password, and other account credentials.
Your membership is intended for your personal use.
You may not:
sell or transfer your account
share your login credentials in a manner that gives unauthorized individuals access to membership content
allow multiple unrelated individuals to use a single membership account
attempt to access another member’s account without permission
You are responsible for activity occurring through your account unless the activity results from circumstances outside your reasonable control.
Please contact us promptly if you believe your account has been accessed without authorization.
4. Membership Plans
Illuminating Watercolor may offer different membership levels, including plans such as Essential and Studio Plus.
Different membership levels may provide different access.
Depending on the plan selected, membership benefits may include:
access to the on-demand watercolor course library
live class series
live workshops
critiques and Q&A sessions
recordings of past live classes and workshops
downloadable handouts and guides
reference photographs
community participation
newly released instruction
Certain content, including live instruction and live-class replays, may be limited to designated membership levels.
We will make reasonable efforts to clearly describe what is included in each plan before purchase.
5. Subscription Billing and Automatic Renewal
Unless expressly stated otherwise, paid Illuminating Watercolor memberships are recurring subscription services.
By purchasing a recurring membership, you authorize the applicable payment provider to charge the payment method you provide at the billing interval disclosed at checkout.
Depending on the membership selected, billing may occur monthly, annually, or at another clearly disclosed interval.
Your membership will automatically renew unless canceled before the next renewal date.
Applicable taxes may be added where required by law.
6. Membership Price Changes
We may change membership prices from time to time.
A price change will not ordinarily alter the price of a membership period for which you have already paid.
Where required by law, we will provide appropriate notice before a new price applies to a future renewal.
If you do not wish to continue at a new renewal price, you may cancel your membership before the applicable renewal date.
7. Cancellation
You may cancel a recurring membership at any time.
Cancellation prevents future automatic renewal charges.
Unless otherwise stated, you will generally continue to have access to the Services through the end of the membership period for which you have already paid.
Deleting an app, closing your browser, or simply ceasing to use the Services does not cancel an active subscription.
If your membership was purchased through an app store, marketplace, or other third party, cancellation may need to be completed directly through that provider.
8. 30-Day Money-Back Guarantee
New Illuminating Watercolor memberships are covered by a 30-day money-back guarantee.
You may take up to 30 days from your initial membership purchase to explore the courses, watch lessons, use the available resources, and determine whether Illuminating Watercolor is right for you.
If you are not satisfied, contact us within that 30-day period and request a refund.
You do not need to provide a detailed explanation for your request.
Unless otherwise stated at checkout, this guarantee applies to the initial purchase of a new membership.
After the initial 30-day guarantee period, subscription payments and renewal charges are generally non-refundable except where required by applicable law or where we expressly agree otherwise.
Nothing in this section limits consumer rights that cannot legally be waived.
9. Third-Party Purchases
Some purchases or memberships may be processed through third-party services, payment processors, app stores, or marketplaces.
When a third party controls the transaction, billing, cancellation, and refund procedures may also be governed by that provider’s terms.
We may not have the ability to directly issue or process refunds for transactions controlled by a third party.
10. Payment Processing
Payments may be processed by third-party payment providers such as Stripe, PayPal, app stores, or other authorized payment services.
By making a purchase, you agree to provide accurate billing information and authorize the applicable provider to process the transaction.
Dylan Scott Pierce Studios does not ordinarily store complete credit or debit card numbers on its own systems.
11. Live Classes, Workshops, and Critiques
Certain membership levels may include live instruction offered throughout the year.
Live programming may include:
multi-week class series
workshops
demonstrations
critiques
question-and-answer sessions
special educational events
We make reasonable efforts to provide live programming consistent with the membership description.
However, dates, times, subjects, schedules, formats, or other details may occasionally change because of illness, scheduling needs, technical problems, emergencies, or circumstances outside our reasonable control.
When practical, we may reschedule a session, provide a recording, substitute comparable instruction, or otherwise address a disrupted live event.
12. Live-Class Recordings
Live classes, workshops, critiques, and Q&A sessions may be recorded and made available to eligible members.
If you participate in a live session, your display name, voice, video, chat comments, questions, or artwork you voluntarily share may appear in the recording.
By voluntarily participating in a recorded session, you understand that these contributions may become part of a replay available within Illuminating Watercolor.
If you prefer not to appear visually in a recording, you may keep your camera turned off where the applicable platform permits.
13. Artwork Submitted for Critique or Discussion
You retain ownership of artwork that you create and submit.
If you voluntarily submit artwork for a live critique, class discussion, community discussion, or similar educational activity, you grant Dylan Scott Pierce Studios a limited, non-exclusive license to display that artwork as reasonably necessary to conduct the activity.
If the class, critique, or discussion is recorded, your artwork may appear as part of the resulting recording or replay.
This permission does not transfer ownership or copyright in your artwork to us.
We will not separately sell your artwork or reproduce it as unrelated merchandise without additional permission.
14. Community Participation
Illuminating Watercolor may include community features that allow members to share artwork, ask questions, comment, participate in discussions, and interact with other artists.
We want the community to remain respectful, educational, welcoming, and supportive.
You may not use the community to:
harass, threaten, abuse, or intimidate another person
post hateful, discriminatory, obscene, defamatory, or unlawful material
impersonate another person
post spam or unauthorized advertising
repeatedly solicit members for unrelated commercial services
upload viruses, malicious software, or harmful code
attempt to gain unauthorized access to accounts or systems
post material that violates another person’s copyright, privacy, publicity, or other legal rights
scrape or collect information about other members without authorization
deliberately disrupt the community or interfere with its educational purpose
We may moderate, restrict, edit, or remove content that we reasonably believe violates these Terms or interferes with operation of the community.
Serious or repeated violations may result in suspension or termination of membership access.
15. Your Community Content
You retain ownership of original artwork, photographs, comments, questions, written posts, and other original materials you submit through the Services.
By posting content, you grant Dylan Scott Pierce Studios a limited, non-exclusive license to host, store, reproduce, display, and technically process that content as reasonably necessary to operate Illuminating Watercolor.
For example, if you upload an image of your painting to the community, the platform must be able to display that image to other authorized members.
This license does not transfer ownership of your artwork to us.
If we would like to use your artwork, photograph, story, or other content for advertising or promotional purposes outside the ordinary operation of the Services, we may request separate permission where appropriate.
16. Testimonials
If you voluntarily provide a testimonial and authorize us to use it for promotional purposes, you grant Dylan Scott Pierce Studios permission to reproduce and display the testimonial in connection with Illuminating Watercolor.
We may make minor edits for spelling, grammar, formatting, punctuation, or length so long as those edits do not materially change the meaning of your statement.
You may contact us with questions or concerns regarding a testimonial attributed to you.
17. Intellectual Property
Unless otherwise stated, the content available through Illuminating Watercolor is owned by Dylan Scott Pierce Studios, Dylan Scott Pierce, or our licensors and is protected by copyright and other intellectual-property laws.
Protected content includes, without limitation:
instructional videos
live-class recordings
course materials
demonstrations
artwork
photographs
reference photographs
written lessons
diagrams
downloadable PDFs
handouts
guides
exercises
graphics
audio recordings
logos
website design
teaching materials
Your membership provides a limited, personal, non-exclusive, non-transferable, revocable license to access eligible content for your own educational and artistic use.
Purchasing a membership does not transfer ownership or copyright in the content to you.
18. Permitted Personal Use
You may:
watch courses and lessons included with your membership
download resources when a download option is provided
print provided handouts for your personal study
take personal notes
practice techniques demonstrated in the courses
create your own original paintings using concepts and techniques you learn
use authorized reference materials for personal artistic study where permitted
Unless a particular resource states otherwise, you may display, exhibit, gift, or sell your own original paintings created through your study of watercolor techniques.
19. Prohibited Use of Course Materials
Without prior written permission from Dylan Scott Pierce Studios, you may not:
copy or redistribute course videos
screen-record or otherwise record protected membership content
upload membership content to another website, platform, or service
share downloadable PDFs, handouts, guides, or other member resources outside your membership
redistribute reference photographs
sell or sublicense our instructional materials
republish teaching materials as your own
reproduce substantial portions of lessons in another course, workshop, book, website, membership, or paid educational product
remove copyright notices, watermarks, or ownership information
make protected membership content publicly available
use automated tools to scrape, extract, or systematically download membership content
use proprietary course materials, instructional content, photographs, or downloadable resources to train artificial-intelligence systems or datasets without prior written permission
You remain free to apply the artistic knowledge, techniques, and skills you learn to your own original artwork.
20. Reference Photographs
Reference photographs provided through Illuminating Watercolor are intended for educational and artistic study unless otherwise stated.
Where Dylan Scott Pierce Studios owns or has authority to provide a reference photograph for painting purposes, you may create your own original artwork based on that reference.
This does not give you the right to redistribute, publish, sell, sublicense, or otherwise distribute the reference photograph itself.
Any additional restrictions stated with a particular reference image will control.
21. Your Finished Artwork
The intellectual-property protections in these Terms do not prevent you from creating your own original paintings using techniques you learn through Illuminating Watercolor.
Unless a particular reference or exercise contains a specific restriction, you may:
display your finished artwork
exhibit it
gift it
sell your original painting
You may not sell or redistribute our original photographs, lesson materials, videos, handouts, PDFs, or other copyrighted instructional resources themselves.
22. Availability of Content
Illuminating Watercolor is continually developed and updated.
Specific courses, videos, live replays, handouts, reference materials, categories, community features, and other content may be added, revised, reorganized, replaced, or removed over time.
We do not guarantee that every individual item of content will remain available indefinitely.
We will make reasonable efforts to maintain a substantial instructional library consistent with the membership offering.
23. Access After Membership Ends
When your paid membership ends, access to gated membership content will generally end as well.
This may include access to:
course videos
live-class replays
community areas
critiques
member-only reference photographs
downloadable resources
Materials you lawfully downloaded while your membership was active may continue to be used for your personal study unless the individual resource states otherwise.
The copyright, intellectual-property, and redistribution restrictions in these Terms continue after your membership ends.
24. Educational Purpose and Artistic Results
Illuminating Watercolor provides educational instruction.
Every artist develops at a different pace.
Results depend on many factors, including:
prior experience
practice
materials
time
individual ability
artistic goals
application of the instruction
We cannot guarantee:
a particular level of artistic improvement
completion of specific paintings
professional success
exhibition acceptance
awards
sales of artwork
income from art
any particular artistic result
Examples and testimonials describe individual experiences and do not guarantee identical results for every member.
25. Art Materials and Safety
Watercolor painting and related artistic practices may involve paints, pigments, masking materials, adhesives, blades, tools, sprays, or other art materials.
You are responsible for:
reading and following manufacturer instructions
using suitable ventilation where necessary
safely handling and storing art materials
keeping potentially hazardous materials away from children and pets
determining whether a material or technique is appropriate for your circumstances
Any discussion of art materials through Illuminating Watercolor is educational and does not replace manufacturer safety instructions.
26. Recommended Supplies and Affiliate Links
We may recommend watercolor supplies, books, equipment, or other products that we believe may be useful.
Some links may be affiliate links, meaning Dylan Scott Pierce Studios may receive a commission if you purchase through the link, at no additional cost to you.
Where legally required, affiliate relationships will be disclosed.
Product recommendations reflect our educational judgment and experience, but we do not guarantee the suitability or performance of third-party products.
27. Third-Party Websites and Services
Illuminating Watercolor uses and may link to third-party services.
These may include:
website providers
membership platforms
payment processors
videoconferencing or livestream services
email providers
analytics providers
retailers
social-media platforms
Third-party services have their own terms, privacy policies, availability, security practices, and operating procedures.
We are not responsible for third-party websites or services that we do not control.
The inclusion of a third-party link does not necessarily constitute an endorsement of that provider.
28. Electronic Communications
By creating an account, making a purchase, contacting us electronically, or using the Services, you consent to receive necessary electronic communications from us.
These may include:
account notices
billing information
membership communications
password-reset emails
service announcements
legal notices
Where permitted by law and subject to your preferences, we may also send marketing or educational communications.
Electronic communications satisfy legal requirements that notices be provided in writing where permitted by applicable law.
29. Service Availability
We work to keep Illuminating Watercolor available and functioning properly, but uninterrupted access cannot be guaranteed.
The Services may occasionally be unavailable because of:
maintenance
technical problems
Internet outages
third-party platform failures
security incidents
software updates
emergencies
circumstances outside our reasonable control
Temporary interruptions do not automatically entitle a member to a refund, although we may provide an appropriate remedy where circumstances reasonably warrant one.
30. Suspension or Termination
We may suspend, restrict, or terminate access if we reasonably believe that a member has materially violated these Terms.
Reasons may include:
unauthorized sharing or redistribution of membership content
account-sharing abuse
copyright infringement
fraud or payment abuse
harassment of other members
security violations
unlawful activity
repeated disruption of the community
Where appropriate, we may first provide a warning and an opportunity to correct the issue.
Serious violations may result in immediate termination.
A member terminated for a material violation of these Terms may not be entitled to a refund except where required by applicable law.
31. Privacy
Your use of Illuminating Watercolor is also subject to our Privacy Policy.
The Privacy Policy explains how personal information is collected, used, disclosed, and protected.
The Privacy Policy should be read together with these Terms.
32. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We make reasonable efforts to provide high-quality instruction and reliable access.
However, we do not warrant that:
the Services will always be uninterrupted
the Services will always be error-free
every technical issue will be corrected immediately
every item of content will remain available indefinitely
use of the Services will result in a particular artistic outcome
Nothing in this section excludes warranties, protections, or consumer rights that cannot legally be excluded.
33. Limitation of Liability
To the fullest extent permitted by applicable law, Dylan Scott Pierce Studios and its owners, employees, contractors, representatives, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to a paid Service will not exceed the amount you paid to Dylan Scott Pierce Studios for that Service during the twelve months immediately preceding the event giving rise to the claim.
These limitations do not apply where prohibited by applicable law.
Nothing in these Terms limits liability that cannot legally be limited.
34. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Dylan Scott Pierce Studios, its owners, employees, contractors, and agents from claims, damages, liabilities, and reasonable expenses arising from:
content you knowingly submit in violation of another person’s legal rights
your unlawful use of the Services
your material violation of these Terms
This provision does not apply to the extent prohibited by applicable consumer law.
35. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except where prohibited by applicable law, if a dispute arising out of or relating to these Terms or the Services cannot be resolved informally, either party may require that the dispute be resolved through final and binding arbitration rather than in court.
Arbitration will be conducted by a single neutral arbitrator pursuant to the Federal Arbitration Act and administered by the American Arbitration Association, or another mutually agreed arbitration provider.
The arbitration may take place in Colorado, at another mutually agreed location, or remotely where appropriate and permitted by the applicable arbitration rules.
The arbitrator will have authority to resolve disputes concerning the interpretation and enforceability of this arbitration provision.
The arbitrator’s decision will be final and binding, subject to any review rights provided by applicable law.
Judgment on the arbitration award may be entered in any court having jurisdiction.
Nothing in this section prevents either party from pursuing an eligible claim in small claims court or seeking emergency or injunctive relief where permitted by law.
This arbitration provision survives termination of these Terms.
36. Class Action Waiver
To the fullest extent permitted by applicable law, disputes arising from or relating to these Terms or the Services will be resolved on an individual basis.
Neither you nor Dylan Scott Pierce Studios may bring or participate in a claim as a plaintiff or class member in a class, collective, consolidated, representative, or private-attorney-general proceeding.
Unless both parties agree otherwise or applicable law requires otherwise, an arbitrator may not consolidate the claims of more than one person or preside over any form of representative proceeding.
If applicable law does not permit enforcement of this waiver in a particular circumstance, the waiver will apply only to the extent legally permitted.
37. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws applicable in your jurisdiction require otherwise.
For disputes that are not subject to arbitration and that may properly be brought in court, the parties consent to jurisdiction and venue in the appropriate state or federal courts located in Colorado, subject to any rights that cannot legally be waived.
Nothing in these Terms deprives a consumer of protections or rights that cannot legally be waived under applicable law.
38. International Users
Dylan Scott Pierce Studios operates from Colorado, United States.
If you access Illuminating Watercolor from outside the United States, you are responsible for complying with applicable laws in your jurisdiction.
Nothing in these Terms is intended to limit consumer rights that cannot legally be waived under the laws that apply to you.
39. Changes to the Services
We may modify Illuminating Watercolor as the program develops.
Changes may include updates to:
website design
course organization
instructional content
community features
technology
membership functionality
live-event scheduling
We will make reasonable efforts not to materially reduce the principal benefits of a prepaid membership period without appropriate reason or notice.
40. Changes to These Terms
We may revise these Terms from time to time to reflect changes in:
our Services
business practices
technology
applicable law
membership offerings
The revised Terms will display an updated “Last Updated” date.
Where required by law or reasonably appropriate, we may provide additional notice of material changes.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
41. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.
The remaining provisions will continue in effect.
42. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean we have waived our right to enforce that provision later.
43. Assignment
You may not transfer or assign your membership or rights under these Terms without our prior written permission.
We may transfer our rights and obligations in connection with a legitimate merger, acquisition, sale, reorganization, or transfer of the Services, subject to applicable law.
44. Entire Agreement
These Terms, together with our Privacy Policy and any plan-specific terms clearly presented at checkout, constitute the agreement between you and Dylan Scott Pierce Studios concerning your use of Illuminating Watercolor.
If a specific purchase, promotion, or service includes additional written terms, those additional terms will apply to that purchase, promotion, or service.
